Service Agreement

This agreement is made between you and Jin Xuan Holdings Sdn Bhd (SSM-200801008028) and its related corporations, where applicable ("Company", "Jin Xuan", "we", "us" or "our") when you access, browse, download, register, use or interact with our official website at jinxuan.com.my, mobile application, official social media accounts, messaging channels, online ordering channels, third-party delivery platform pages, content, services or any related features provided by us ("Official Platforms" and "Services").

By using our Official Platforms or Services, you agree to be bound by these Terms of Use. If you do not agree with any part of these Terms, please stop using our Official Platforms and Services.

Declaration and Consent
1. By accessing or using our Official Platforms and Services, you confirm that you have read, understood and agreed to these Terms of Use.
2. If you are below 18 years old, you should obtain consent from your parent or legal guardian before using our Official Platforms, placing any order, submitting any personal information, contacting us online, or interacting with our Services.
3. Jin Xuan reserves the right to amend, update or replace these Terms of Use at any time without prior notice. Any changes may be posted on our website, mobile application, official social media accounts or other online platforms, and shall take effect from the date stated.
4. Your continued use of our Official Platforms or Services after any changes are posted will be deemed as your acceptance of the revised Terms of Use.
Use of Our Official Platforms and Services
1. You agree to use our Official Platforms and Services only for lawful purposes and in accordance with the laws of Malaysia.
2. You shall not use our Official Platforms, Services, content, ordering system or communication channels in any way that may:
  1. breach any applicable law, regulation or third-party rights;
  2. infringe any trademark, copyright, privacy right, intellectual property right or other legal right;
  3. provide false, inaccurate, incomplete or misleading information;
  4. attempt to gain unauthorised access to our website, mobile application, servers, systems, accounts, databases or communication channels;
  5. upload, transmit or distribute viruses, malware, spam or any harmful code;
  6. interfere with the normal operation, security or performance of our Official Platforms or Services;
  7. impersonate any person, company, customer, employee or representative of Jin Xuan;
  8. misuse our brand name, logo, content, images, mascot, character design or promotional materials; or
  9. carry out any activity that we consider inappropriate, harmful, abusive, fraudulent or damaging to Jin Xuan, our employees, customers, partners or users.
3. Jin Xuan reserves the right to suspend, restrict or terminate your access to our Official Platforms or Services if we reasonably believe that you have breached these Terms of Use.
User Accounts, App Access and Security
1. Where our mobile application, online ordering system or related Services require account registration, you agree to provide accurate, current and complete information.
2. You are responsible for maintaining the confidentiality of your login details, password, verification code and any activity conducted through your account.
3. You shall not allow any third party to use your account, login details or verification code without permission.
4. If you believe that your account, login details or verification code have been stolen, misused or compromised, you should notify us as soon as possible.
5. Jin Xuan shall not be responsible for any loss, damage, unauthorised transaction or activity that occurs due to your failure to protect your account, device, login details or personal information.
Privacy Protection
1. We may collect and process personal information that you voluntarily provide to us, including but not limited to your name, contact number, email address, enquiry details, order-related information, reservation details, delivery information, feedback, website usage data, app usage data, social media interaction data and other information submitted through our Official Platforms or Services.
2. Such information may be used for the following purposes:
  1. responding to enquiries, feedback or requests;
  2. processing orders, reservations, delivery-related matters, takeaway requests or customer service matters;
  3. improving our website, mobile application, products, services and customer experience;
  4. sharing updates, promotions, campaigns, announcements or marketing information where permitted;
  5. managing online interactions, social media communications and customer support;
  6. conducting internal records, research, analysis, marketing activities and service improvement; and
  7. complying with legal, regulatory, operational or business requirements.
3. By using our Official Platforms or submitting your information to us, you consent to the collection, use, disclosure and processing of your personal information in accordance with our Privacy Policy and applicable laws.
Website, App and Service Availability
1. Jin Xuan does not guarantee that our website, mobile application, official social media accounts, online ordering channels, delivery platform pages or Services will always be available, uninterrupted, secure, error-free or fully updated.
2. We shall not be liable for any loss, damage, delay or inconvenience caused by website downtime, app downtime, system interruption, maintenance, technical failure, internet service issues, platform issues, cyber attacks, payment gateway issues, third-party service disruption, force majeure events or circumstances beyond our reasonable control.
3. We may update, suspend, modify, remove or discontinue any part of our Official Platforms or Services at any time without prior notice.
Orders, Delivery, Return and Refund
1. Any dine-in, takeaway, delivery, catering, frozen dim sum or other food order may be subject to product availability, outlet operating hours, payment confirmation, third-party platform terms and our internal order acceptance process.
2. Product availability, prices, promotions, delivery areas, delivery charges, packaging, menu items and operating hours may vary by outlet, platform, campaign period or service channel.
3. For orders placed through third-party platforms such as GrabFood or other delivery partners, the order, payment, delivery, cancellation and refund process may also be subject to the terms, policies and procedures of the respective platform.
4. Due to the nature of freshly prepared food products, all completed food orders are generally not refundable, returnable or exchangeable unless there is a valid and verifiable issue with the order.
5. If there is any discrepancy, missing item, wrong item, damaged product or quality concern, you should contact the relevant Jin Xuan outlet, our customer service team or the relevant third-party delivery platform as soon as possible, together with proof of purchase and clear supporting details.
6. Jin Xuan reserves the right to review each request on a case-by-case basis before deciding whether a replacement, refund, credit or other solution may be offered.
7. Products should be checked upon collection or delivery. Any refund, replacement or compensation request may be declined if the issue is reported late, unsupported, caused by mishandling after collection or delivery, or not reasonably verifiable.
Payment
1. Payment methods may vary depending on whether the order is placed at a Jin Xuan restaurant, through our website, mobile application, official contact channels, online ordering channels, or through a third-party delivery or ordering platform.
2. All payments must be completed using the payment methods accepted by the relevant outlet, platform or service provider.
3. For orders placed through third-party platforms, payment processing is handled by the relevant platform and may be subject to their payment terms, security checks, refund procedures and processing timelines.
4. Jin Xuan shall not be responsible for payment errors, transaction failures, unauthorised payments, bank delays, e-wallet issues, payment gateway issues, platform issues or delays caused by banks, card issuers, payment processors, e-wallet providers or third-party service providers.
Promotions, Campaigns and Online Content
1. Any promotion, campaign, discount, voucher, giveaway, contest, limited-time offer, social media activity or online announcement may be subject to its own terms and conditions.
2. Jin Xuan reserves the right to amend, suspend, cancel or withdraw any promotion, campaign, discount, voucher, giveaway or offer at any time without prior notice.
3. Promotional visuals, product images, videos, captions, descriptions and campaign materials shown on our Official Platforms are for general information and illustration purposes only.
4. Actual products, packaging, serving style, presentation, portion, ingredients, availability and prices may vary depending on outlet, preparation, season, platform or campaign period.
5. We reserve the right to moderate, hide, delete or report any comments, messages, reviews, tags, posts or user-generated content on our Official Platforms that we consider inappropriate, offensive, misleading, abusive, spam-related, fraudulent, defamatory or damaging to Jin Xuan, our employees, customers, partners or users.
Third-Party Platforms and External Links
1. Our Official Platforms may contain links to third-party websites, delivery platforms, payment gateways, social media platforms, maps, videos or other external services.
2. These third-party platforms are operated by independent service providers and may be subject to their own terms of use, privacy policies, payment terms, delivery policies and platform rules.
3. Jin Xuan is not responsible for the content, accuracy, availability, security, payment process, delivery performance, privacy practices or service quality of any third-party platform.
4. Your use of any third-party platform is at your own discretion and risk.
Limitation of Liabilities
1. Jin Xuan is responsible only for obligations expressly stated in these Terms of Use.
2. While we aim to keep the information on our Official Platforms accurate and updated, we do not guarantee that all content, prices, product details, outlet information, promotions, availability, operating hours or service details are always complete, accurate or current.
3. Product images, videos and promotional visuals shown on our Official Platforms are for illustration purposes only. Actual products may vary due to preparation, ingredients, presentation, outlet conditions or availability.
4. To the fullest extent permitted by law, Jin Xuan shall not be liable for any indirect, incidental, special, consequential, punitive or other damages arising from your use of our Official Platforms, Services, third-party platforms, online content, product information or communication channels.
5. You are responsible for making your own decision before placing an order, visiting an outlet, relying on online information, interacting with our social media content, downloading our mobile application or using any third-party delivery or ordering platform.
Trademark, Character Design and Intellectual Property Rights
1. All trademarks, logos, brand names, trade names, text, images, photographs, videos, graphics, illustrations, mascots, cartoon characters, character designs, animations, website design, mobile application design, social media content, layout, content and other materials displayed on our Official Platforms are owned by Jin Xuan or used with permission.
2. This includes, but is not limited to, Jin Xuan’s brand identity, logos, mascots, cartoon designs, character illustrations, social media characters, promotional visuals, packaging artwork, marketing materials, videos, photography, digital content and any related creative assets developed for Jin Xuan.
3. You may not copy, reproduce, edit, modify, adapt, distribute, publish, display, upload, transmit, use or exploit any content, mascot, cartoon design, character, visual asset, brand element or intellectual property from our Official Platforms for commercial or unauthorised purposes without prior written consent from Jin Xuan.
4. You may not use Jin Xuan’s name, logo, mascot, cartoon character, character design, social media content, packaging artwork, product images or any related creative assets in a way that may mislead the public, imply endorsement, damage our brand reputation or create confusion with Jin Xuan.
5. Any unauthorised use of Jin Xuan’s brand, logo, mascot, cartoon design, character, images, videos, content or intellectual property may result in legal action.
Notices
1. Any notice, update, policy change or announcement relating to these Terms of Use may be posted on our website, mobile application, official social media accounts, online platforms, email, WhatsApp or any other communication channel we consider appropriate.
2. Such notices shall be deemed effective once published, posted or communicated through the relevant channel.

Jurisdiction
1. These Terms of Use shall be governed by and interpreted in accordance with the laws of Malaysia.
2. Any dispute, controversy or claim arising out of or relating to these Terms of Use shall be subject to the jurisdiction of the courts of Malaysia.
